Terms of Use — Backgammon Reserve

These Terms govern your use of Backgammon Reserve (the "app"). By creating an account or using the app you agree to them. If you don't agree, please don't use the app.


1. The app at a glance

Backgammon Reserve is a backgammon-only iOS app. There is no real money, no in-app currency, no purchases of coins or chips, no wagering, and no gambling mechanics of any kind. Ratings shown in the app are for entertainment and matchmaking; they have no monetary value.

2. Eligibility

To use the app you must be at least 13 years old. If you're under the age of majority where you live, you may only use the app with a parent's or guardian's consent. The app is rated 4+ on the App Store, but the chat feature (currently in ranked matches only) is intended for older players; if Apple updates the rating to 12+ once chat is widely enabled, that updated rating governs.

3. Your account

You sign in via Sign in with Apple. You're responsible for keeping your Apple ID secure. You're responsible for activity that happens under your account.

You're also responsible for the username you choose. Don't pick a name that:

We can require you to change a username that violates these rules. Repeat offenders may have their account suspended.

4. Acceptable use

While using the app, please don't:

We reserve the right to suspend or terminate accounts that violate these rules. For ranked play we may also revert rating changes obtained through cheating.

5. User content

"User content" means anything you submit through the app, including your username, your avatar, and chat messages.

6. Chat (ranked matches only)

Chat is offered as a courtesy to make ranked play feel less anonymous. By using it you agree:

If you don't want to use chat, you can mute the opponent at the start of every match, or play bot or pass-and-play matches (which don't have chat).

7. Ratings and match results

The Elo-style rating shown in the app is for matchmaking and bragging rights only. It is not a financial instrument, has no cash value, and cannot be transferred, sold, or exchanged.

We may adjust ratings, recompute leaderboards, or roll back match results if a bug, exploit, or cheating is discovered. We'll give notice of any large-scale rollback.

Bot and pass-and-play matches do not affect ratings.

8. Service availability

The app is provided AS IS. We don't promise:

We may, with reasonable notice, add features, change them, or remove them. We may end the service entirely if maintaining it is no longer practical — in that case we'll give as much notice as we reasonably can and let you export your data.

9. Termination

You can stop using the app at any time. To fully delete your account and all associated data, use Profile → Delete Account in the app, or email backgammonreserve@gmail.com and we'll do it for you.

We can terminate or suspend your account if you violate these Terms or if we have a good-faith belief your activity is harmful to other players or to the service.

10. Disclaimers

To the maximum extent permitted by applicable law, the app is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied — including any warranty of merchantability, fitness for a particular purpose, accuracy of ratings, or non-infringement. We do not warrant that the app is error-free or that defects will be corrected on any specific schedule.

11. Limitation of liability

To the maximum extent permitted by law, Backgammon Reserve (the developer, contributors, and anyone who helps run the app) is not liable for:

For anything we are liable for, our total liability is limited to the greater of (a) the amount you paid for the app in the past 12 months (which is zero — the app is free) and (b) USD $25.

Some jurisdictions don't allow these limits; if so, the limits above apply to the maximum extent allowed by the laws of your jurisdiction.

12. Indemnification

If a third party brings a claim against us because you violated these Terms or misused the app, you agree to indemnify us against that claim to the extent permitted by your local law. We try to keep that provision narrow — it covers things like you cheating in a way that prompts a third-party legal action, not normal use of the app.

13. Apple's role

You're downloading the app through the Apple App Store. These Terms are between you and the developer of Backgammon Reserve, not between you and Apple. Apple has no obligation to provide maintenance or support for the app. To the extent any term here conflicts with Apple's own Licensed Application End User Licence Agreement, Apple's agreement controls for the parts where Apple's rules are stricter.

14. Changes to these Terms

We can update these Terms. When we do, we'll bump the "Last updated" date at the top. For material changes (anything that materially expands what you owe us, what we collect, or what you can be punished for) we'll notify you in the app the next time you open it. Continued use of the app after a change means you accept the new Terms.

15. Governing law and disputes

These Terms are governed by the laws of the United States and of the state in which the developer is located, without regard to conflict-of-laws principles. Disputes that can't be resolved informally will be brought in the courts of that state. If you live somewhere whose consumer-protection law gives you stronger rights, those stronger rights still apply.

We always prefer to resolve disputes by talking. Email us at backgammonreserve@gmail.com before considering anything more formal.

16. Severability and waiver

If any part of these Terms turns out to be unenforceable, the rest still applies. Our not enforcing a right one time doesn't mean we waive it.
